The terms used in this Privacy Policy document have the following meanings:

Personal Data Controller (hereinafter referred to as “PDC”) – a natural or legal person, public authority, unit or other entity that, alone or jointly with others, determines the purposes and means of processing personal data, i.e. in this case, ALUMETAL-TECHNIK SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ SPÓŁKA KOMANDYTOWA with its registered office in Łódź, ul. św. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Personal data – information relating to an identified or identifiable natural person (“data subject”); An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

Processing – an operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collecting, recording, organizing, structuring, storing, adapting or modifying, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, matching or combining, restricting, deleting, or destroying.

Website – an online service operated by the Data Controller, accessible through various web browsers.

User – any natural person visiting the Website or using one or more services or functionalities described in the Policy.

This document describes how all information about Website Users is collected, processed, and used. This Privacy Policy provides detailed information regarding the principles and purposes of processing your personal data.

2. Purpose and legal basis for processing your personal data
Using our Website may require you to share your personal data with the Data Controller. We process the information provided in complete confidentiality and use it only for the purposes we have informed you of. Due to the various purposes of data processing, it is up to you to decide whether you wish to provide it to us. To ensure transparency, the Data Controller (PDC) presents a summary of personal data processing operations below.

User Service, Contact Forms, and Social Media
The Data Controller allows you to contact the Data Controller via available communication channels, including, in particular, email, telephone, social media channels (Facebook, Messenger, LinkedIn), and electronic contact forms. This will require you to provide the personal data necessary to contact the Data Controller and for the Data Controller to respond. Therefore, the Data Controller will process your personal data for the following purposes:
Receiving your contact request, including a request for a quote, processing it, and providing a response.
Legal basis: legitimate interest of the Data Controller (Article 6, paragraph 1, letter f of the GDPR); necessity of processing for the performance of the contract (Article 6, paragraph 1, letter b of the GDPR);
Receiving your complaint, processing it, and providing a response.
Legal basis: legitimate interest of the Data Controller (Article 6, paragraph 1, letter f of the GDPR). Processing is necessary for the performance of a contract (Article 6 paragraph 1 letter b of the GDPR), compliance with a legal obligation to which the Data Controller is subject (Article 6 paragraph 1 letter c of the GDPR);

Retention of correspondence for the limitation period for potential claims.

Legal basis: consent to data processing for marketing purposes (Article 6, paragraph 1, letter a of the GDPR in conjunction with Article 398 of the Electronic Communications Act); legitimate interest of the Data Controller (Article 6, paragraph 1, letter f of the GDPR) in direct marketing of its own products or services;
Sending email notifications about interesting offers or content, which in some cases contain commercial information

Analytical, statistical, survey, and opinion poll activities
Your personal data may be processed by the Data Controller for analytical and statistical purposes. In such a case, the Data Controller uses your personal data to analyze your activity on our Website and to improve its functionality. The ability to process information collected via cookies for analytical and statistical purposes depends on your consent to store such information on your end device (laptop, telephone, tablet, etc.). The Data Controller may also process personal data collected through surveys and research conducted via email or telephone. The Data Controller will conduct these activities to obtain opinions about the Data Controller and the products offered by the Data Controller. Therefore, with the above in mind, the Data Controller will process your data for the following purposes:
Conducting statistical analyses
Legal basis: consent to the storage of cookies (Article 6, paragraph 1, letter a of the GDPR); The legitimate interest of the Data Controller in analyzing the activity of Website Users (Article 6, paragraph 1, letter f of the GDPR);

Cookies used to store so-called “session status” help improve services and enhance the browsing experience, as well as maintaining the session status – if a customer logs in to their panel, cookies enable the session to be maintained. This means that after switching to a different subpage, there is no need to re-enter their login and password, which improves the user experience;

4. Requirement to provide personal data
Providing your personal data is voluntary, but in some cases, it is necessary for us to fulfill your expectations regarding the use of our contact form available on our website.

5. Period of storage of personal data
The period of storage of your personal data depends on the purpose and legal basis of their processing:
in the scope of processing your data for purposes arising from legitimate interests pursued by the Data Controller, i.e. direct marketing, pursuant to Article 6(1)(f) of the General Data Protection Regulation, your personal data will be processed until you object to the processing of your personal data for the purposes of such marketing,
in the case of processing your data for the provision of electronic services, pursuant to Article Pursuant to Article 6(1)(b) of the General Data Protection Regulation, your data will be stored by the Data Controller until the statute of limitations for any claims under guarantees and warranties expires, but no less than 5 years from the beginning of the year following the financial year in which the operations, transactions, and proceedings were finally completed, paid off, settled, or time-barred.

With respect to the processing of your personal data for the purpose of sending commercial information, until you withdraw your consent to data processing.

Rights of entities whose personal data are processed
In connection with the processing of your personal data, you have the right to the following rights:
Right to access your data. You have the right to obtain confirmation as to whether your personal data are being processed by the Data Controller, as well as specific information, e.g., regarding the purposes of processing, the categories of data processed, etc. You also have the right to access your personal data, in the form of obtaining a copy of it.
Right to rectification. You have the right to request that the Data Controller immediately rectify your personal data if it is inaccurate or incomplete.

Right to erasure (“right to be forgotten”). You can request the erasure of your personal data, for example, if the data has been used unlawfully or if you have withdrawn your consent to further data processing. However, the “right to be forgotten” does not constitute an absolute right to erasure of your personal data, as there are certain exceptions, for example, if the Data Controller needs to continue using your personal data to establish, pursue, or defend legal claims, or to comply with a legal obligation.

Right to restriction of processing. You have the right to prevent the Data Controller from further using your personal data, for example, if the Data Controller is in the process of assessing a request to rectify your data. If the processing of your Personal Data is restricted, the Data Controller may still store it, but may not actively use it further unless you consent to this.

Right to data portability. You have the right to receive and reuse certain personal data for your own purposes from other, separate data controllers. You may exercise this right only in relation to personal data that the Data Controller processes by automated means with your consent or for the performance of a contract. Right to object. If the processing of your Personal Data was based on the Data Controller’s legitimate interest, you have the right to object to its further processing. The Data Controller may refuse to exercise the above right if it demonstrates compelling legitimate grounds for processing that override your interests, rights, and freedoms, or grounds for establishing, pursuing, or defending legal claims.

Right to withdraw consent. If the processing of your Personal Data is based on consent, you have the right to withdraw, at any time, all or some of your consents regarding the processing of your data for a specific purpose. This consent will not affect the processing of your data prior to your withdrawal or the legal basis for such processing.

The request should, to the extent possible, precisely specify the request, in particular:
the right you wish to exercise;
the purpose of processing your request relates to.

7. Recipients of Personal Data
The recipients of your personal data are the Data Controller and its authorized representatives, including in particular the entity providing the Data Controller’s email hosting service, Google LLC, based in Mountain View, USA.
8. Transfer of Personal Data to Third Countries
In connection with the use of marketing and analytical tools such as Google Ads, Google Analytics, and Google Tag Manager, your personal data (e.g., IP address, cookie identifiers, website activity data) may be transferred outside the European Economic Area, in particular to the United States.

Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) is certified under the EU-U.S. Data Privacy Framework, which ensures an adequate level of protection of personal data in accordance with the European Commission’s implementing decision of 10 July 2023.
Data will only be transferred if you voluntarily consent to the use of marketing and analytical tools – in accordance with Article 6(1)(a) and Article 49(1)(a) of the GDPR.
You have the right to withdraw your consent at any time through the cookie settings available on the website.
Personal Data Security
We would like to assure you that your personal data is processed by the Data Controller in accordance with applicable law, including, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). The Data Controller conducts ongoing risk analyses to assess the risks inherent in processing and has implemented appropriate measures, such as encrypting the Data Controller’s website and all connections, to minimize this risk. Our website is encrypted using an SSL certificate, which serves to confirm the owner of the page and encrypts communication between the user’s web browser and the server. Furthermore, the Data Controller has implemented measures to ensure an appropriate level of security, including confidentiality. In assessing the data security risk, the Data Controller considered the risks associated with the processing of personal data, including accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or unauthorized access to personal data transmitted, stored, or otherwise processed, and has taken appropriate measures to prevent the consequences.

10. Right to lodge a complaint
If you believe that the processing of your personal data violates the provisions of the General Data Protection Regulation, you have the right to lodge a complaint with a supervisory authority.

In matters not covered by this Privacy Policy, the current regulations on personal data protection apply.
